These Terms of Service (“Agreement”) govern your use of StoryWisp's AI-powered storytelling platform and all related services, features, and applications (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these terms.

StoryWisp (operated by JJH Solutions Ltd) is designed to help children develop reading skills through creative storytelling, with content aligned to UK educational standards and age-appropriate learning objectives.

Acceptance of Terms

By using StoryWisp, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

Child Safety and Privacy

StoryWisp is designed to be used by children only under the supervision and consent of a parent or legal guardian. Protecting children's privacy and safety is a core principle of our Service.

StoryWisp complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our data handling practices are aligned with recognised international children's privacy standards.

For Parents and Guardians:

• You must be 18 years or older to create an account
• You are responsible for supervising your child's use of the Service
• You must provide verified parental or guardian consent for any child profile created
• You are responsible for ensuring any uploaded content (including photos) may lawfully be used

For Children:

• Always ask a parent or guardian before using StoryWisp
• Do not share personal information with other users
• Tell a trusted adult if something on the Service makes you uncomfortable

Educational Content and Disclaimers

StoryWisp provides educational content designed to support children's reading development. Our stories are aligned with UK phonics frameworks and educational standards.

Important Educational Disclaimers:

• Stories are provided for educational and entertainment purposes only
• Content is not a substitute for professional educational, medical, or psychological advice
• Learning outcomes may vary depending on age, ability, and engagement
• Parents and guardians remain responsible for supporting their child's learning and should consult qualified educators where specific educational needs exist

User Accounts and Responsibilities

To use StoryWisp, you must create an account and provide accurate information. You are responsible for maintaining the security of your account.

Account Requirements:

• One account per person or family
• Accurate and up-to-date information
• Secure password and login credentials
• Immediate notification of any unauthorized access

Content and Intellectual Property

StoryWisp uses artificial intelligence to generate stories, characters, and illustrations based on user input.

Your Rights:

• You retain ownership of the stories and characters you create using the Service
• You may use your content for personal and educational purposes
• You may share stories within your family or for non-commercial use

Our Rights:

• We retain all rights to the StoryWisp platform, software, AI systems, designs, and educational frameworks
• We may use anonymised and aggregated content to improve, test, and enhance our AI systems
• We do not use identifiable child data or personal content for advertising or marketing purposes

Nothing in these Terms transfers ownership of your content to us.

AI-Generated Content

StoryWisp uses artificial intelligence to generate stories, illustrations, and character images based on user selections and preferences.

• AI-generated content may occasionally contain inaccuracies, inconsistencies, or unexpected results
• While we aim to provide age-appropriate and educational content, AI systems are not infallible
• We do not guarantee specific educational outcomes or learning improvements
• Parents and guardians are encouraged to review generated content with their children

AI-generated content does not constitute professional advice of any kind.

Photo Uploads and Character Creation

Our Service allows parents or guardians to upload photos for the purpose of creating personalised character artwork.

By uploading a photo, you confirm that:

• You have the legal right to use the photo and to consent to its processing
• The photo may be processed temporarily through our AI systems solely to generate character artwork

Additional terms:

• Original photos are deleted immediately after processing and are not stored permanently
• Only the AI-generated character artwork is retained within the Service
• Photo uploads are optional and characters can be created without photos
• You may request deletion of character images at any time

Print Book Services

StoryWisp offers printed book services through our fulfillment partner, Prodigi. When you order a printed book:

• Your story content and delivery address are shared with Prodigi for fulfillment
• Print orders are subject to Prodigi's terms and conditions
• Delivery times and shipping costs vary by location
• We are not responsible for printing defects or delivery issues handled by Prodigi
• Refunds for print orders are handled on a case-by-case basis

Print Pricing: Soft cover books start at £19.95, hard cover books at £24.95, plus £5.50 shipping per book.

Prohibited Uses

To maintain a safe and educational environment, the following activities are strictly prohibited:

• Creating content that exploits, harms, or endangers children
• Generating inappropriate, violent, or harmful material
• Attempting to bypass security measures or access restrictions
• Sharing personal information of children or other users
• Using the Service for commercial purposes without permission
• Reverse engineering or attempting to extract our AI models
• Creating multiple accounts to circumvent usage limits

Subscriptions, Free Trials, and Cancellation

StoryWisp offers subscription plans with different features and usage limits.

Free Trial

• New users may receive a 7-day free trial with access to selected features
• No payment is required during the trial period

Paid Subscriptions

• Wisp Medium: £6.99/month
• Wisp Premium: £12.99/month

Subscriptions:

• Are billed monthly in advance
• Renew automatically unless cancelled
• Are processed securely via Stripe

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds are issued for unused time

After Cancellation

• You retain access to all stories already created
• You will not be able to create new stories without an active subscription

Limitation of Liability

Nothing in these Terms limits or excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under applicable law

Subject to the above, and to the maximum extent permitted by law, StoryWisp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Service.

Our total liability to you for any claims arising out of or in connection with this Agreement shall not exceed the total amount paid by you to StoryWisp in the 12 months preceding the claim.

Termination

Either party may terminate this Agreement at any time. We may suspend or terminate your account if you violate these terms.

Upon termination, your right to use the Service ceases immediately, but certain provisions of this Agreement will survive termination.

Indemnification

You agree to indemnify, defend, and hold harmless JJH Solutions Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any third-party rights
• Content you upload or create through the Service

General Terms

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and JJH Solutions Ltd regarding the Service and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to any successor or affiliate.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of government, or failures of third-party services.

Third-Party Rights

These Terms do not create any rights for any third party. No person who is not a party to this Agreement shall have any right to enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under consumer protection laws that cannot be excluded or limited.
